A tax appeal to the Court of Appeal lies only on questions of law. A complaint inviting the Court to re-evaluate evidence or raising mixed questions of fact and law is outside its jurisdiction.

The medical-insurance exemption did not apply because life insurance is not medical insurance, even where the policy includes critical-illness benefits.

The real importance of the case is that it establishes a substance-over-form approach to employee benefits. An employer cannot avoid PAYE merely because a benefit is packaged as a group arrangement or labelled insurance.
More importantly, it is a warning on tax appellate practice: before the Court of Appeal, the battle is not about re-arguing evidence. The appeal must identify a genuine error of law, wrong statutory interpretation, or an unsupported or perverse legal conclusion.
